Program Purpose / Objectives
Joint Commission Leadership Standard LD.02.04.01 requires that "the hospital manages conflict between leadership groups to protect the quality and safety of care." It is clear that the Joint Commission expects each hospital and its medical staff to have a dispute resolution mechanism in place. However, other than for the basic elements of the process (Elements of Performance under LD.02.04.01), the JC leaves it up to each hospital to fashion their own means of compliance.

Most have simply adopted policies that mimic the JC's directives, but are short on detail, essentially leaving conflict resolution to a case-by-case process. Unfortunately, this typically results in the parties falling into their familiar routine: "lawyering up" and setting the litigation machine into motion. Similarly healthcare providers need to more effective utilize negotiation, mediation and other conflict resolution strategies to improve medical care and reduce the potential for medical malpractice litigation.

Topics:
  1. Introduction to Health Care Conflicts
    • Describe different types of healthcare conflicts (ADR)
  2. Methods of Dispute Resolution in Healthcare
    • Define Methods of Dispute Resolution in Healthcare
  3. Negotiation Strategies
    • Explain positional negotiation and interest based negotiation
  4. Basic mediation techniques
    • Summarize basic mediation techniques
  5. Mediation of Provider Patient Complaints
    • Describe mediation strategies in resolving patient complaints
  6. Mediation of Medical Ethics Complaints
    • Summarize mediation strategies to address bioethics issues
  7. Mediation and Negotiation Strategies to Resolve Other Conflicts
    • Summarize the role of negotiation and mediation methods to resolve other healthcare issues
Additional topics under development

Ports of Call

San Juan, Puerto Rico - In days of yore, the waters near Puerto Rico teemed with pirate ships commanded by the likes of Sir Francis Drake. Aye, they are long gone, but in their wake they have left an island of national treasures: La Casa Blanca, built in 1501 for the island's first governor, Ponce de Leon; the cobblestone streets of Old San Juan; the tropical rain forests of El Yunque.

Charlotte Amalie, St. Thomas, U.S.V.I. - Named after a Danish Queen, Charlotte Amalie has one of the most breathtaking deepwater harbors in the world. The key sights of Charlotte Amalie are located within the town centre, making it easy to combine sightseeing with St. Thomas’ fantastic shopping opportunities. Eighteenth century architecture provides the perfect backdrop for walking tours and shopping here in the "Duty Free Capital of the World." For a dose of history, visit Emancipation Park, the American-Caribbean History Museum, or Bluebeard the pirate's castle at Magen’s Bay. If tropical bliss is what you're after, head to any of Charlotte Amalie’s pristine beaches, where the warm water, white sands and palm trees will lull you into deep relaxation!

Basseterre, St. Kitts - Basseterre is the capital of the Caribbean island federation of Saint Kitts and Nevis. It's the gateway to popular Saint Kitts beaches like South Friars Bay. At the city's heart, Independence Square has an Italian-inspired fountain. Just off the Circus traffic circle, with its Victorian Berkeley Memorial Clock Tower, is the National Museum. In the stately Old Treasury Building, it explores the islands' colonial past.

St. John's, Antigua -

Castries, St. Lucia - Watch natives fashion boats from gum trees, write postcards in a Creole cafe. Shop for black coral carvings and exquisite silk-screened fabrics.

Bridgetown, Barbados - An island some say is more British than Britain. Here, cricket is the national sport and afternoon tea goes without saying. But Barbados is true blue Caribbean as well, with classic sand beaches, and wild monkeys in the jungle.
